You’ll understand the title in just a moment…

For the last few months my laptop has been in bad shape.  Such bad shape I’ve been using a backup laptop. [1]  Something on my laptop’s motherboard went bad and killed the battery. [2][3]  I could still use it – but I had to keep it plugged in all the time.  If I needed to move it, I had to shut it down all the way, move it, then boot it up – since it had no battery life at all.

Well, Dell’s kick ass incredible customer service took care of me – once again.  I can’t thank these guys enough for going above and beyond.  I’ve said it before and I’ll say it again, my next laptop is going to be a Dell. Thanks to Lionel my laptop is sporting a totally brand-spanking new motherboard and power cord.  I’ve also just slapped in a totally new battery as well.

Anyhow, I’m beyond happy. [4]

2. You see, the motherboard – it went bad.  It was one bad mother…  Oh, forget it.

Ye olde cell fone

Here’s some trivia for you.  I have the world’s crappiest cell phone.  I get a lot of flack for my cell phone.  It’s beat to hell, got a cracked screen, dented, scratched, and it’s ridiculously old.

How old?  Well, March 15 will be the six year anniversary of the FCC’s acceptance.  My cell carrier has been sending me ever more frantic flyers for the latest cell phones for about four years now.  It’s gotten pretty pathetic, really.

Unfortunately my trusty phone is now taking it’s last gasps and I need to find a replacement.  :(

Anyone want to kick the tires?

Antivirus Pro 2010 SCAM

My father in law’s laptop is infected with a very nasty program called “Antivirus Pro 2010.”  It disables a bunch of core Windows functions, messes with other programs, shuts down the computer randomly, tells you the computer has a virus (which is technically true), and then offers to help you out for $40.00.  In reality, this program is itself malware/spyware etc.

The problem is that it really looks like its an official MicroSoft or Windows program! [1]

After several attempts and trying to use numerous different programs, I’ve been unsuccessful in deleting it.  It installs pieces of itself all over the computer – and if you don’t delete each piece it will install the entire thing all over again.  The various recommendations I’ve seen on the internet have been ineffectual.

If When I finally remove it, I’ll post the information here.

A little while ago William S. Morris, an Applicant’s attorney, told me that the Ogilvie adjustment calculation could be further simplified. [1] He suggested the following[2] :

   1. L = (PIESSE – PIEA) / PIESSE
2. Individualized Proportional Earnings Loss
   1. = (WPI / L) / 100
3. DFEC Adjustment Factor
   1. = ([1.81/a] * .1) + 1
   2. = ( (1.81 * .1)/a) + 1
   3. = (.181/a) + 1
   4. = 1 + (.181/a)
4. Ogilvie DFEC Adjusted Rating
   1. = WPI * DFEC Adjustment Factor
   2. = WPI * (1 + (.181/a) )
   3. = WPI * (1 + (.181 / Individualized Proportional Earnings Loss) )
   4. = WPI * (1 + (.181 / ( (WPI / L) / 100) ) )
   5. = WPI * (1 + (18.1 / ( (WPI / L)  ) )
   6. = WPI * (1 + (18.1 * (L/WPI) ) )
   7. = WPI + (18.1 * L)
5. Conclusion
   1. If the injured workers’ individualized proportional earnings loss is outside all of the FEC ranks, you may calculate the Ogilvie adjustment by adding (18.1*Earnings Loss) to the WPI.

The only flaw with the proofs offered by William and myself is that they are too exact.  The WCAB in Ogilvie never sets forth the exact process for performing the Ogilvie adjustment calculation – so the only official method involves rounding to different significant figures at different places.  Thus, a calculation performed in strict accordance with the WCAB in Ogilvie and through one of these mathematical proofs would differ very slightly.

Easy-to-make iPhone

A company once told me someone had offered to build permanent disability calculators for their website in three months for $7,500.  One said six months and $20,000.  Recently, another suggested it would take them a year and $40,000.  My response is usually some variation on “You’ve got to take that deal.  You’re wasting your time talking to me.”

It’s no big secret that building a great product takes a lot of work.  The important thing to remember is that just because something is easy-to-use, that doesn’t mean its easy-to-make. [1]

Difficult-to-make iPhone

Let’s take the iPhone for example.  Everyone will concede its an easy phone to use.  However, it was released more than two years ago on 6/29/2007. [2]  In that time the other players – BlackBerry, LG, Nokia, and Palm have all been trying to catch up.  If this easy-to-use phone were easy-to-build everyone would have their own version.

Look, there’s no special magic to building a website like this.  Really, anyone can do it.  All you have to do is learn the calculations inside-and-out, deconstruct the math involved in the various calculations, learn some client and server side programming languages, learn a content management system, make it all work together, keep current on changes in the law, start all over again each time the law changes, and earn the respect of the workers’ compensation community.  Once done, you’ll have your very own workers’ compensation calculator website!

To return to the lesson of the iPhone, building a touch screen phone that can play music and surf the web is totally doable.  Doing it right is another matter entirely.

Don't worry, its not your fault

Yesterday I received an e-mail from a beta tester, Jeff Duarte, who was having trouble with one of my calculators.  He said that he didn’t really understand how to use a particular calculator.  My response was:

The problem is not you, its me.  :)  If I designed my calculator better you wouldn’t have any questions.

Seriously – sorry Jeff, its my bad.  My goal is to make these calculators so easy and intuitive to use that no workers’ compensation professional would have any trouble figuring out how to use them.  If you don’t figure out how to use it just by looking at it, I designed it wrong. [1] Getting feedback is a very important and instructive process for me.  It lets me figure out what works for people and what doesn’t.

The good news is that Jeff”s suggestions have given me an idea on how to make two calculators easier to use and for two entirely new features!

So, send me an e-mail if you have an idea on how I can make a calculator more intuitive, easier to use, or just plain work better!

There's nothing silly about Verify!®

A few weeks ago I launched a Social Security Number verification tool powered by Verify!®.  Since its launch its become a very popular tool.  One of the coolest things about having these calculators is finding out all of the new ways people think of to use them.  These new and unintended uses are almost always far more interesting than the original pedestrian reasons for which a tool was created.

Take Silly Putty for instance.  Silly Putty was originally created as a potential replacement for rubber during World War II.  It didn’t work as a replacement for rubber, scientists were unable to think of a use for it, and it sat in a lab for years before a toy store owner began stuffing it in plastic eggs.[1]

Here are a few ideas:

1. Use it to determine whether someone is a U.S. citizen.
2. Use it to double-check someone’s year of birth.
3. Use it to determine approximately when someone became a U.S. citizen.[2]
4. Use it to determine whether someone is potentially Medicare eligible.[3]

What other uses can you think of?

Happy Birthday PDRater!

I’ve been so busy lately I completely forgot to mention PDRater’s second birthday![1]

This site was launched on July 23, 2007.  For both of you who were using it back then, you remember it was an ugly ugly baby.

I’ve really enjoyed working on this website for the last two years.  I use the word “work,” but I don’t really mean it.  Building calculators, creating charts, and unraveling the mysteries of Ogilvie are my hobbies too.  :)

What would you like to see from this website in the coming year?  Please let me know in the comments or send me an e-mail.  I already have several (more) new calculators in the pipeline, but I’m always open to ideas.

This guinea pigs finds PDRater easy to use!

I have several new calculators in the works and could use a few guinea pigs to help test them.  A few days ago I sent an e-mail to a select few of this website’s users asking them to participate.  As a result of their testing and feedback, I’ve made a few changes to these new calculators.

However, I’d also appreciate the help of anyone interested in testing.  If you are willing to provide feedback and want to try out these new calculators, please send me an e-mail.

Privacy, please!

I recently launched a new social security verification tool.  One user raised some very important issues – privacy and security. [1] The commenter pointed out that the Verify!® social security number lookup tool did not appear to utilize a secure connection – and could permit the unintended dissemination of private information.

To this, I make the following statements/suggestions:

1. This website does not utilize secure connections.  There, I’ve said it.  If this is a concern for you, no one will blame you for not using this tool.
2. This SSN look up tool does not ask for any other information besides the social security number.  By itself, the social security number probably isn’t particularly useful to anyone.
3. The commenter’s concerns about keyloggers and viruses are valid.  However, such things would be able to access your information no matter how secure I make this website.
4. Its generally a good idea to be very careful about what information you send out onto the internet.  If you’re not sure something is safe, it probably is not.
5. By using this site you’re agreeing to the disclaimers, terms of use, and privacy policy.  If you still have additional questions, you can always try to e-mail me.

I’m working on several more workers compensation calculators.  I’m really excited about one of them in particular. [1]

I’ve been working to develop calculators and search engines that are easier to use, easier to understand, and make them available to everyone for less than my competitors.  One benefit to doing it all myself is that I can innovate faster than anyone else.  For instance, my wildly popular Ogilvie calculator was available to beta testers just days after the Ogilvie case came out.

But, this new calculator is something entirely new.  Tantalized?  Titilated?  Tremulous?

It is strongly encouraged you take the EAMS survey

The Division of Workers’ Compensation has posted a link to an EAMS survey.  I noticed a lot of fliers around the Oakland District office of the Workers’ Compensation Appeals Board for this survey in the last few weeks.

Having taken the survey, I’m not optimistic its going to do anyone any good.  My problem with the survey is the inherent question bias.

Several of the survey questions deal with the availability and efficacy of EAMS training resources.  Take it from someone who actually designs software user interfaces – if people don’t like the user interface or the way your software works, they will either not use it or try to find ways around it.  The only viable solution is to design a system that doesn’t need a lot of training and explanation.

This is really shows the engineering perspective on the problem.  Once engineers have designed the system, its up to the user to read the manual and figure it all out.  The problem is not sufficient education, training, and understanding.  People are not suddenly going toembrace EAMS because now they understand how it works.

While its more work to comb through open ended responses from users, at least those answers will be more representative of their opinions.  Take the final question, for example:  “Please identify the top 3 improvements that you would like to see in EAMS . Please choose three and rank them in order of priority.”  Your only choices are:

• Completing the OCR forms (formatting issues)
• Completing the OCR forms (ambiguity re: required information)
• Completing the OCR forms (technical issues)
• Document processing times at the WCAB offices
• WCAB clerks’ lack of knowledge regarding EAMS
• Availability of EAMS information and documents when appearing at the WCAB for hearings.
• Procedural inconsistencies amongst WCAB offices
• Too much paper
• Too few forms available online
• Cover sheet / Separator Sheet
• Limited availability of EAMS Access for external users
• Limited amount of information available on public search
• Assistance with EAMS forms from DWC call center
• Other

This can’t possibly be an exhaustive list of user concerns with EAMS.  What other EAMS related issues do you perceive?

If you’re using my Ogilvie calculator for situations involving a 100% earnings loss, you’re working too hard. [1]

If you have 100% earnings loss and WPI less than 45, the Ogilvie adjustment formula will always result in WPI + 18.

A defense attorney friend of mine called me up yesterday to say (I’m paraphrasing here), “You jackass.  Thanks to your Ogilvie proof every Applicant’s attorney I know is calling me up, gloating, and asking for 18 points on top of the whole person impairment on every case!  Why the hell did you do that???”[1]   My first thought was of my favorite quote from Swingers.[2] What I actually said was something along the lines of:

• It’s not like CAAA wouldn’t have found out about Ogilvie if it wasn’t for Jay Shergill mentioning it in a blog post.
• Nothing has changed except that now anyone can perform an Ogilvie adjustment calculation in their head.[3]
• Someone was going to prove that Ogilvie adds 18 points to the WPI in virtually all litigated workers’ compensation cases, so it might as well be me.

Broken calculators? Nothing a little duct tape won't fix...

Yesterday from about noon to 4pm the server which hosts this website (and many others) was down.  This unfortunately lead to an interruption for which I apologize.[1]  During this time I was unable to send/receive emails and the website was unavailable.

The hosting company I use is very good.  When there’s been downtime it normally occurs during non-peak hours and is very short in duration.  This was an anomaly.

Anyhow, everything is back on line and open for business.

WordPress Upgrade

Since updating this website to WordPress v2.8 in the middle of June they’ve released two additional security updates.  Unfortunately, the latest update also required a little extra tinkering and work on my part.  I look on constant security fixes for this fantastic (free!) open source software as a small price to pay for increased security.

Again, the calculators should all be completely impervious to changes in the WordPress program itself.  However, its theoretically possible you might notice a little weirdness in how the website looks/acts.  If so, please drop me a line and let me know so I can take a look.

• Added to and edited the “About” page
• Put together a database of the various WCAB district offices so that I can continue my series of posts providing photos, contact information, and driving directions to each office

PDRater workers' compensation calculators - so easy your cat can use them!

What’s that?  You haven’t memorized ALL of the FEC ranks to go with each of the 2005 Permanent Disability Rating Schedule body parts? [1]

Why didn’t you say so?   (Actually, someone did ask for an easy way to look up the FEC ranks back on April 1).

I’ve been working on an easy way to allow a user to look up and quickly insert the FEC rank for the affected body part.  I finally got around to building it a few days ago and launched it this morning.  Please give it a shot and let me know what you think.

Here’s all you need to do to perform your very own Ogilvie calculation:

1. Go to the permanent disability calculator page. (If you haven’t already signed up for free, this is a good time.)
2. Click “Ogilvie” Diminished Future Earning Capacity Calculator “
3. Type in the FEC rank OR click “FEC Rank (1-8)” and click on the injured body part.  It will look up the FEC rank and insert it for you.
4. Type in the “Whole Person Impairment”
5. Type in the “Post Injury Earnings of Applicant”
6. Type in the “Post Injury Earnings of Similarly Situated Employees” OR click the link to obtain some information from the EDD Labor Market Information Division (LMID) and US Department of Labor, Bureau of Labor Statistics (BLS).

If you can think of a way for me to make this calculator even easier, please let me know. [2]
