<p>You&#8217;ll understand the title in just a moment&#8230;</p>
<p>For the last few months my laptop has been in bad shape.  Such bad shape I&#8217;ve been using a backup laptop. [<a href="http://www.pdrater.com/2010/09/one-bad-mother-shut-your-mouth/#footnote_0_3259" id="identifier_0_3259" class="footnote-link footnote-identifier-link" title="Trust me, the back up laptop is nothing to brag about.">1</a>]  Something on my laptop&#8217;s motherboard went bad and killed the battery. [<a href="http://www.pdrater.com/2010/09/one-bad-mother-shut-your-mouth/#footnote_1_3259" id="identifier_1_3259" class="footnote-link footnote-identifier-link" title="You see, the motherboard &amp;#8211; it went bad.&nbsp; It was one bad mother&amp;#8230;&nbsp; Oh, forget it.">2</a>][<a href="http://www.pdrater.com/2010/09/one-bad-mother-shut-your-mouth/#footnote_2_3259" id="identifier_2_3259" class="footnote-link footnote-identifier-link" title="The photo does not belong to me and is probably the property of MGM.">3</a>]  I could still use it &#8211; but I had to keep it plugged in all the time.  If I needed to move it, I had to shut it down all the way, move it, then boot it up &#8211; since it had no battery life at all.</p>
<p><a href="http://www.pdrater.com/2009/01/dell-customer-service/" target="_self">Well, Dell&#8217;s kick ass incredible customer service took care of me &#8211; once again</a>.  I can&#8217;t thank these guys enough for going above and beyond.  <strong>I&#8217;ve said it before and I&#8217;ll say it again, my next laptop is going to be a Dell.</strong> Thanks to <a href="http://www.pdrater.com/2009/01/dell-customer-service/" target="_self">Lionel</a> my laptop is sporting a totally brand-spanking new motherboard and power cord.  I&#8217;ve also just slapped in a totally new battery as well.</p>

<p>Here&#8217;s some trivia for you.  I have the world&#8217;s crappiest cell phone.  I get a lot of flack for my cell phone.  It&#8217;s beat to hell, got a cracked screen, dented, scratched, and it&#8217;s ridiculously old.</p>
<p>How old?  Well, <a href="http://www.phonescoop.com/phones/phone.php?p=504#Specs" target="_blank">March 15 will be the six year anniversary of the FCC&#8217;s acceptance</a>.  My cell carrier has been sending me ever more frantic flyers for the latest cell phones for about <em>four years</em> now.  It&#8217;s gotten pretty pathetic, really.</p>
<p>Unfortunately my trusty phone is now taking it&#8217;s last gasps and I need to find a replacement.  :(</p>

<p>My father in law&#8217;s laptop is infected with a very nasty program called &#8220;Antivirus Pro 2010.&#8221;  It disables a bunch of core Windows functions, messes with other programs, shuts down the computer randomly, tells you the computer has a virus (which is technically true), and then offers to help you out for $40.00.  In reality, this program is itself malware/spyware etc.</p>
<p>The problem is that it really looks like its an official MicroSoft or Windows program! [<a href="http://www.pdrater.com/2009/10/scam-alert-antivirus-pro-2010/#footnote_0_3486" id="identifier_0_3486" class="footnote-link footnote-identifier-link" title="Photo courtesy of bleepingcomputer.com">1</a>]</p>
<p>After several attempts and trying to use numerous different programs, I&#8217;ve been unsuccessful in deleting it.  It installs pieces of itself all over the computer &#8211; and if you don&#8217;t delete each piece it will install the entire thing all over again.  The various recommendations I&#8217;ve seen on the internet have been ineffectual.</p>
<p><span style="text-decoration: line-through;">If</span> <em><strong>When </strong></em>I finally remove it, I&#8217;ll post the information here.</p>

<p>The only flaw with the proofs offered by William and myself is that they are too exact.  The <a href="http://www.pdrater.com/2009/09/ogilvie-ii-2-en-banc-almaraz-guzman-ii-2-en-banc-2009-09-03/" target="_self">WCAB in Ogilvie</a> never sets forth the exact process for performing the <a href="http://www.pdrater.com/2009/07/ogilvie-calculations-made-simple/" target="_self">Ogilvie adjustment calculation</a> &#8211; so the only official method involves <a href="http://www.pdrater.com/2009/03/improve-the-ogilvie-calculator/" target="_self">rounding to different significant figures at different places</a>.  Thus, a calculation performed in strict accordance with the <a href="../2009/09/ogilvie-ii-2-en-banc-almaraz-guzman-ii-2-en-banc-2009-09-03/" target="_self">WCAB in Ogilvie</a> and through one of these mathematical proofs would differ very slightly.</p>

<p>A company once told me someone had offered to build <a href="http://www.pdrater.com/original-calculators/" target="_self">permanent disability calculators</a> for their website in three months for $7,500.  One said six months and $20,000.  Recently, another suggested it would take them a year and $40,000.  My response is usually some variation on &#8220;You&#8217;ve got to take that deal.  You&#8217;re wasting your time talking to me.&#8221;</p>
<p>It&#8217;s no big secret that building a great product takes a lot of work.  The important thing to remember is that <strong>just because something is easy-to-use, that doesn&#8217;t mean its easy-to-make</strong>. <p>Let&#8217;s take the <a href="http://en.wikipedia.org/wiki/IPhone" target="_self">iPhone</a> for example.  Everyone will concede its an easy phone to use.  However, it was released more than two years ago on 6/29/2007. [<a href="http://www.pdrater.com/2009/09/i-just-make-it-look-easy/#footnote_1_2559" id="identifier_1_2559" class="footnote-link footnote-identifier-link" title="Wikipedia link.">2</a>]  In that time the other players &#8211; BlackBerry, LG, Nokia, and Palm have all been trying to catch up.  If this easy-to-use phone were easy-to-build everyone would have their own version.</p>
<p>Look, there&#8217;s no special magic to building a website like this.  Really, anyone can do it.  All you have to do is learn the calculations inside-and-out, deconstruct the math involved in the various calculations, learn some client and server side programming languages, learn a content management system, make it all work together, keep current on changes in the law, start all over again each time the law changes, and earn the respect of the workers&#8217; compensation community.  Once done, you&#8217;ll have your very own <a href="http://www.pdrater.com/original-calculators/" target="_self">workers&#8217; compensation calculator website!</a></p>
<p>To return to the lesson of the iPhone, building a touch screen phone that can play music and surf the web is totally doable.  Doing it <em><strong>right </strong></em>is another matter entirely.</p>

<p>Yesterday I received an e-mail from a beta tester, Jeff Duarte, who was having trouble with one of my <a href="http://www.pdrater.com/original-calculators/" target="_self">calculators</a>.  He said that he didn&#8217;t really understand how to use a particular <a href="http://www.pdrater.com/original-calculators/" target="_self">calculator</a>.  My response was:</p>

<p>Seriously &#8211; sorry Jeff, its my bad.  My goal is to make these calculators so easy and intuitive to use that no workers&#8217; compensation professional would have any trouble figuring out how to use them.  If you don&#8217;t figure out how to use it just by looking at it, <span style="text-decoration: underline;">I designed it wrong</span>. [<a href="http://www.pdrater.com/2009/09/its-not-you-its-me/#footnote_0_3253" id="identifier_0_3253" class="footnote-link footnote-identifier-link" title="Photo courtesy of TreMichLan.&nbsp; Terrible pun &amp;#8211; all me!">1</a>] Getting feedback is a very important and instructive process for me.  It lets me figure out what works for people and what doesn&#8217;t.</p>
<p>The <em>good</em> news is that Jeff&#8221;s suggestions have given me an idea on how to make two calculators easier to use and for two <em>entirely new </em>features!</p>

<p>A few weeks ago I launched a <a href="../2009/08/another-new-calculator/" target="_self">Social Security Number verification tool</a> powered by <a href="http://www.verify.com" target="_blank">Verify!®</a>.  Since its launch its become a very popular tool.  One of the coolest things about having these calculators is finding out all of the new ways people think of to use them.  These new and unintended uses are almost always far more interesting than the original pedestrian reasons for which a tool was created.</p>
<p>Take Silly Putty for instance.  <a href="http://en.wikipedia.org/wiki/Silly_Putty#History_of_Silly_Putty" target="_blank">Silly Putty was originally created as a potential replacement for rubber during World War II</a>.  It didn&#8217;t work as a replacement for rubber, scientists were unable to think of a use for it, and it sat in a lab for years before a toy store owner began stuffing it in plastic eggs.[<a href="http://www.pdrater.com/2009/08/what-do-you-use-verify-the-social-security-number-verification-tool-for/#footnote_0_3249" id="identifier_0_3249" class="footnote-link footnote-identifier-link" title="Photo courtesy of unloveablesteve">1</a>]</p>
<p>Here are a few ideas:</p>
<ol>
<li>Use it to determine whether someone is a U.S. citizen.</li>
<li>Use it to double-check someone&#8217;s year of birth.</li>
<li>Use it to determine approximately when someone became a U.S. citizen.[<a href="http://www.pdrater.com/2009/08/what-do-you-use-verify-the-social-security-number-verification-tool-for/#footnote_1_3249" id="identifier_1_3249" class="footnote-link footnote-identifier-link" title="I thought of this one during a deposition last week when a deponent couldn&amp;#8217;t recall when they first came to the United States.&nbsp; I just fired up the cell phone web browser, went to the calculator page, and asked the follow up question.">2</a>]</li>

<p>I&#8217;ve really enjoyed working on this website for the last two years.  I use the word &#8220;work,&#8221; but I don&#8217;t really mean it.  <a href="http://www.pdrater.com/2009/08/calling-all-guinea-pigs/" target="_self">Building calculators</a>, <a href="http://www.pdrater.com/2009/08/ogilvie-youre-working-too-hard/" target="_self">creating charts</a>, and <a href="http://www.pdrater.com/2009/07/ogilvie-calculations-made-simple/" target="_self">unraveling the mysteries of Ogilvie</a> are my hobbies too.  :)</p>

<p>To this, I make the following statements/suggestions:</p>

<li>This website does not utilize secure connections.  There, I&#8217;ve said it.  If this is a concern for you, no one will blame you for not using this tool.</li>
<li>This <a href="http://www.pdrater.com/2009/08/verify-social-security-number-validator/" target="_self">SSN look up tool</a> does not ask for any other information besides the social security number.  By itself, the social security number probably isn&#8217;t particularly useful to anyone.</li>
<li>The commenter&#8217;s concerns about keyloggers and viruses are valid.  However, such things would be able to access your information no matter how secure I make this website.</li>
<li>Its generally a good idea to be very careful about what information you send out onto the internet.  If you&#8217;re not sure something is safe, it probably is not.</li>

<p>I&#8217;m working on several <a href="http://www.pdrater.com/original-calculators/" target="_self">more workers compensation calculators</a>.  I&#8217;m <span style="text-decoration: underline;">really</span> excited about one of them in particular. [<a href="http://www.pdrater.com/2009/08/even-more-workers-compensation-calculators/#footnote_0_3205" id="identifier_0_3205" class="footnote-link footnote-identifier-link" title="Photo courtesy of Wal mink">1</a>]</p>
<p>I&#8217;ve been working to develop calculators and search engines that are easier to use, easier to understand, and make them available to everyone for less than my competitors.  One benefit to doing it all myself is that I can innovate faster than anyone else.  For instance, my <a href="http://www.pdrater.com/original-calculators/" target="_self">wildly popular Ogilvie calculator</a> was available to beta testers just days after the <a href="http://www.pdrater.com/2009/02/ogilvie-and-almaraz-en-banc/" target="_self">Ogilvie</a> case came out.</p>
<p>But, this new calculator is something <strong>entirely new</strong>.  Tantalized?  Titilated?  Tremulous?</p>

<p>The <a href="http://www.dir.ca.gov/dwc/">Division of Workers&#8217; Compensation</a> has posted a link to an <a href="http://www.surveymonkey.com/s.aspx?sm=oAHlaFSWosOd5LihQLwqyw_3d_3d" target="_blank">EAMS survey</a>.  I noticed a lot of fliers around the Oakland District office of the Workers&#8217; Compensation Appeals Board for this survey in the last few weeks.</p>
<p>Having taken the survey, I&#8217;m not optimistic its going to do anyone any good.  My problem with the survey is the inherent question bias.</p>
<p>Several of the survey questions deal with the availability and efficacy of EAMS training resources.  Take it from someone who actually designs software user interfaces &#8211; if people don&#8217;t like the user interface or the way your software works, they will either not use it or try to find ways around it.  The <strong>only</strong> viable solution is to design a system that doesn&#8217;t need a lot of training and explanation.</p>
<p>This is really shows the engineering perspective on the problem.  Once engineers have designed the system, its up to the user to read the manual and figure it all out.  The problem is <span style="text-decoration: underline;">not</span> sufficient education, training, and understanding.  People are not suddenly going toembrace EAMS because now they understand how it works.</p>
<p>While its more work to comb through open ended responses from users, at least those answers will be more representative of their opinions.  Take the final question, for example:  &#8220;Please identify the top 3 improvements that you would like to see in EAMS . Please choose three and rank them in order of priority.&#8221;  Your only choices are:</p>
<ul>
<li>Completing the OCR forms (formatting issues)</li>
<li>Completing the OCR forms (ambiguity re: required information)</li>
<li>Completing the OCR forms (technical issues)</li>
<li>Document processing times at the WCAB offices</li>
<li>WCAB clerks&#8217; lack of knowledge regarding EAMS</li>
<li>Availability of EAMS information and documents when appearing at the WCAB for hearings.</li>
<li>Procedural inconsistencies amongst WCAB offices</li>
<li>Too much paper</li>
<li>Too few forms available online</li>
<li>Cover sheet / Separator Sheet</li>
<li>Limited availability of EAMS Access for external users</li>
<li>Limited amount of information available on public search</li>
<li>Assistance with EAMS forms from DWC call center</li>
<li>Other</li>
</ul>
<p>This can&#8217;t possibly be an exhaustive list of user concerns with EAMS.  What other EAMS related issues do you perceive?</p>

<li>It&#8217;s not like CAAA wouldn&#8217;t have found out about <a href="http://www.pdrater.com/2009/02/ogilvie-and-almaraz-en-banc/" target="_self">Ogilvie</a> if it wasn&#8217;t for Jay Shergill mentioning it in a blog post.</li>
<li><em>Nothing has changed</em> except that now anyone can perform an <a href="http://www.pdrater.com/2009/02/ogilvie-v-city-and-county-of-san-francisco-adj-1177048-sfo-0487779-wcab-en-banc-2-3-2009-dfec-fec-2005-rebuttal-free-workers-compensation-calculator-launched/" target="_self">Ogilvie adjustment calculation</a> in their head.[<a href="http://www.pdrater.com/2009/08/ogilvie-the-finger-pointing-begins/#footnote_2_3154" id="identifier_2_3154" class="footnote-link footnote-identifier-link" title="And save $129.99 in the process">3</a>]</li>
<li>Someone was going to <a href="http://www.pdrater.com/2009/07/ogilvie-calculations-made-simple/" target="_self">prove that Ogilvie adds 18 points to the WPI</a> in virtually all litigated workers&#8217; compensation cases, so it might as well be me.</li>

<p>For the moment, let&#8217;s set aside the issue of whether California&#8217;s injured workers have gotten a raw deal since SB899.  Suppose there&#8217;s an injured worker with a finger injury, stays on temporary disability for two years, and is immediately made permanent and stationary.  If instead they get a 0% WPI, they get nothing.  If they gets a 1% WPI, <a href="../2009/02/ogilvie-v-city-and-county-of-san-francisco-adj-1177048-sfo-0487779-wcab-en-banc-2-3-2009-dfec-fec-2005-rebuttal-free-workers-compensation-calculator-launched/" target="_self">Ogilvie</a> tells us this person gets a DFEC adjusted WPI of 19%.</p>
<p>Nearly every litigated case involves an extended period of temporary disability and a whole person impairment less than 45.[<a href="http://www.pdrater.com/2009/08/ogilvie-the-finger-pointing-begins/#footnote_3_3154" id="identifier_3_3154" class="footnote-link footnote-identifier-link" title="Hell, a permanent irreversible coma is only a WPI of 80.">4</a>]  <a href="../2009/02/ogilvie-and-almaraz-en-banc/" target="_self">Ogilvie</a> effectively <em>removes</em> the first 18% permanent partial disability levels.</p>
<p>I really don&#8217;t think the WCAB intended this consequence.  Don&#8217;t get upset with me &#8211; as long as <a href="http://www.pdrater.com/2009/03/dont-believe-the-hype-almaraz-guzman-is-the-law/" target="_self">Ogilvie is the law</a> I might as well make <a href="../2009/07/ogilvie-calculations-made-simple/" target="_self">Ogilvie calculations</a> easy for you, right?[<a href="http://www.pdrater.com/2009/08/ogilvie-the-finger-pointing-begins/#footnote_4_3154" id="identifier_4_3154" class="footnote-link footnote-identifier-link" title="Remember, just add 18 to the WPI!">5</a>]</div>

<p>Yesterday from about noon to 4pm the server which hosts this website (and many others) was down.  This unfortunately lead to an interruption for which I apologize.[<a href="http://www.pdrater.com/2009/08/back-in-business/#footnote_0_3148" id="identifier_0_3148" class="footnote-link footnote-identifier-link" title="Photo courtesy of mhuang">1</a>]  During this time I was unable to send/receive emails and the website was unavailable.</p>
<p>The hosting company I use is very good.  When there&#8217;s been downtime it normally occurs during non-peak hours and is very short in duration.  This was an anomaly.</p>
<p>Anyhow, everything is back on line and open for business.</p>

<p>Since updating this website to <a href="http://www.pdrater.com/2009/06/website-update-wordpress-2-8/" target="_self">WordPress v2.8</a> in the middle of June they&#8217;ve released two additional security updates.  Unfortunately, the latest update also required a little extra tinkering and work on my part.  I look on constant security fixes for this fantastic (free!) open source software as a small price to pay for increased security.</p>
<p>Again, the calculators should all be completely impervious to changes in the WordPress program itself.  However, its theoretically <em>possible </em>you might notice a little weirdness in how the website looks/acts.  If so, please <a href="http://www.pdrater.com/contact-us/" target="_self">drop me a line</a> and let me know so I can take a look.</p>

<p>Why didn&#8217;t you say so?   (Actually, someone did ask for an <a href="http://www.pdrater.com/2009/04/suggestions-for-the-ogilvie-calculator/" target="_self">easy way to look up the FEC ranks</a> back on April 1).</p>
<p>I&#8217;ve been working on an easy way to allow a user to look up and quickly insert the FEC rank for the affected body part.  I finally got around to building it a few days ago and launched it this morning.  Please give it a shot and let me know what you think.</p>
<p>Here&#8217;s all you need to do to perform your very own <a href="http://www.pdrater.com/original-calculators/" target="_self">Ogilvie calculation</a>:</p>
<ol>
<li>Go to the <a href="http://www.pdrater.com/original-calculators/" target="_self">permanent disability calculator</a> page. (If you haven&#8217;t already signed up for <a href="http://www.pdrater.com/2009/04/no-seriously-its-free/" target="_self">free</a>, this is a good time.)</li>
<li>Click <a onclick="HandSB('dfec'); return false;" href="../original-calculators/#">&#8220;Ogilvie&#8221; Diminished Future Earning Capacity Calculator </a>&#8220;</li>
<li>Type in the FEC rank <strong><span style="text-decoration: underline;">OR</span></strong> click &#8220;FEC Rank (1-8)&#8221; and click on the injured body part.  It will look up the FEC rank and insert it for you.</li>
<li>Type in the &#8220;Whole Person Impairment&#8221;</li>
<li>Type in the &#8220;Post Injury Earnings of Applicant&#8221;</li>
<li style="padding: 1px;">Type in the &#8220;Post Injury Earnings of Similarly Situated Employees&#8221; <strong><span style="text-decoration: underline;">OR</span></strong> click the link to obtain some information from the EDD Labor Market Information Division (LMID) and US Department of Labor, Bureau of Labor Statistics (BLS).</li>
